Gardeners Hayes Service Terms and Conditions

Gardening equipment and outdoor maintenance terms introductionThese Terms and Conditions set out the basis on which Gardeners Hayes provides gardening and related outdoor maintenance services to residential and commercial customers in the UK. By making a booking, confirming an estimate, or allowing work to begin, the customer agrees to these terms. They are intended to create a clear, fair and practical framework for both parties, covering how services are arranged, how payments are handled, what happens if plans change, and the responsibilities of each party while work is taking place.

Throughout this document, references to gardeners in Hayes, Hayes gardening services, or similar wording relate to the service provider operating under the Gardeners Hayes name. These terms apply to routine garden maintenance, hedge cutting, lawn care, clearance work, planting, seasonal tidy-ups, and similar services, unless a separate written agreement states otherwise. Nothing in these terms affects the customer’s statutory rights under UK law.

Booking and service agreement for a garden maintenance providerThe aim of this page is to provide a clear legal framework without unnecessary detail. It should be read carefully before any booking is confirmed. If a particular service needs different conditions, those changes must be agreed in writing. Where a quotation, proposal, or schedule conflicts with these terms, the written service-specific agreement will take priority only to the extent of the conflict.

1. Booking Process

All bookings for Hayes gardeners services are subject to availability and confirmation. A request for work, whether made online, by phone, or through another communication method, does not itself create a binding contract until it has been accepted by Gardeners Hayes. The booking process usually begins with a description of the work required, the property type, access details, and any known issues that may affect the job.

Where needed, a site visit, photographic review, or additional information may be requested before a quotation is issued. Estimates are normally based on the information provided at the time and may be adjusted if the actual conditions differ from those described. Customers should ensure that all relevant details are accurate, including the size of the garden, the condition of the area, and any restrictions on access or parking.

Once the customer accepts a quotation or confirms a service request, Gardeners Hayes may issue a booking confirmation, service date, or work schedule. This confirmation may be provided by email, message, or another written format. The confirmed appointment time is an estimate unless a fixed time has been expressly agreed. Delays may occur due to weather, travel, safety concerns, or the completion of preceding work.

2. Scope of Services

Gardeners Hayes will carry out the services agreed at the time of booking, using reasonable skill and care. The scope of work may include mowing, edging, pruning, hedge maintenance, clearance, planting, weeding, soil improvement, leaf removal, and similar tasks. Any work not expressly included in the agreed service may be treated as additional work and may require an amended price or a separate booking.

Customers are responsible for ensuring that the area to be worked on is reasonably accessible and safe for the agreed service to proceed. If obstacles, hidden hazards, unsafe waste, aggressive pests, protected wildlife, or other issues are discovered, the work may be paused or altered. Gardeners Hayes may refuse to continue where doing so would be unsafe, unlawful, or likely to cause damage.

Where the customer asks for a particular outcome, Gardeners Hayes will aim to deliver that result, but natural conditions, plant health, weather, season, and existing garden condition may affect the outcome. Gardening work is often dependent on living materials and changing outdoor conditions, so exact visual results cannot always be guaranteed. Any advice provided is based on professional experience but should not be treated as a guarantee of future growth or recovery.

3. Prices and Payment Terms

Prices may be quoted as fixed fees, hourly rates, or a combination of both, depending on the nature of the work. Unless stated otherwise, all prices are in pounds sterling and may be subject to VAT where applicable. Written quotations are normally valid for a limited period and may be withdrawn or revised if the job specification changes or if market conditions materially alter costs.

Payment terms will be confirmed in the booking information, invoice, or quotation. In many cases, payment is due on completion of the work, although advance payment or a deposit may be required for larger projects, special-order materials, or reserved appointment slots. Gardeners Hayes may suspend or refuse work if any required deposit or prior balance has not been paid by the agreed date.

Late payment may result in additional administration charges, interest, or recovery action where permitted by law. If a customer disputes part of an invoice, they should pay the undisputed amount on time and raise the issue promptly. Gardeners Hayes reserves the right to withhold future services until outstanding sums are settled in full.

Payment and invoice terms for gardening servicesIf materials are purchased on behalf of the customer, the customer may be charged for the actual cost of those materials plus any agreed handling or collection fee. Where a job runs beyond the original estimate because of additional agreed work, hidden conditions, or changes requested by the customer, further charges may apply. Any such increase should be explained as soon as reasonably possible.

4. Cancellations, Rescheduling and Access

Customers may cancel or reschedule a booking by giving reasonable notice. Where a cancellation is made sufficiently in advance and no costs have been incurred, no charge may apply. However, if the booking is cancelled after preparations have begun, if materials have already been ordered, or if the appointment slot has been reserved and cannot reasonably be reallocated, Gardeners Hayes may charge a cancellation fee or the reasonable costs already incurred.

If the customer is not present where attendance is needed, or if access to the property is not available at the agreed time, the appointment may be treated as a missed visit and charged accordingly. The customer must ensure gates, codes, keys, parking arrangements, and any permissions needed for access are in place before the visit. Delays caused by the customer may reduce the work completed within the booked time.

Gardeners Hayes may reschedule or cancel a service due to adverse weather, staff illness, equipment failure, safety concerns, or circumstances outside reasonable control. In such cases, a new date will usually be offered. Liability for indirect losses arising from unavoidable rescheduling is excluded to the maximum extent permitted by law.

5. Customer Responsibilities

The customer must provide accurate information about the garden, including any known hazards, fragile items, buried utilities, contamination, water features, unstable structures, or areas requiring special care. The customer should also remove or protect items that could be damaged during normal garden operations, such as ornaments, furniture, toys, pet equipment, or delicate containers, unless the parties have agreed otherwise.

Where Gardeners Hayes is expected to work near hidden services, the customer should disclose any relevant information about cables, pipes, drainage, or other underground features. The customer remains responsible for obtaining any permissions required from landlords, managing agents, neighbours, or local authorities, unless a written agreement states that Gardeners Hayes will obtain them.

It is the customer’s responsibility to ensure pets are secured and that the site is safe for workers. If a property contains harmful substances, aggressive animals, or unsafe conditions, the work may be postponed. The customer also agrees not to instruct staff to perform unlawful, dangerous, or clearly inappropriate tasks.

6. Waste Handling and Regulations

Waste removal and environmental compliance for garden workGarden maintenance may create green waste, soil, branches, clippings, packaging, and other debris. Unless otherwise agreed, waste produced during the service will be removed or handled in accordance with the quoted arrangement. Any waste collection fee should be understood as covering the labour, transport, and lawful disposal or recycling of the agreed waste type.

Gardeners Hayes will handle waste in line with relevant UK environmental and waste regulations, including obligations relating to duty of care, safe transport, and proper disposal at licensed facilities where required. Waste will not be illegally dumped, burned, or disposed of in a way that breaches environmental law. If a customer requests disposal of an unusual material, the request may be refused or priced separately depending on its nature and classification.

The customer must disclose any waste that may be hazardous, invasive, contaminated, or subject to special handling requirements. This includes items such as asbestos, chemicals, sharp materials, clinical waste, fuel containers, or any material contaminated by oil, sewage, or animal waste. If prohibited or dangerous waste is discovered, the work may be stopped until appropriate arrangements are made.

7. Liability and Limitations

Gardeners Hayes will exercise reasonable care and skill when performing services. However, gardening work can involve natural variation, weather effects, pre-existing wear, and hidden defects. The company will not be responsible for damage caused by circumstances outside its control, including pre-existing structural weakness, defective fixtures, hidden underground services, or inaccurate information provided by the customer.

Nothing in these Terms and Conditions limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded under UK law. Subject to that, Gardeners Hayes shall not be liable for indirect, consequential, or purely economic losses, loss of profit, loss of business, or loss of enjoyment arising from the provision or non-provision of the services.

Where liability is established, any remedy may be limited to the re-performance of the affected service, a reduction in price, or a refund of the amount paid for the specific service element in question, depending on the circumstances. The total liability of Gardeners Hayes for any claim arising from a particular booking will not exceed the amount paid for that booking, except where the law requires otherwise.

8. Complaints, Variations and Termination

If the customer believes the service has not been carried out properly, they should notify Gardeners Hayes within a reasonable time and provide sufficient information to allow the issue to be reviewed. The company may ask for photographs, dates, or other details. Where appropriate, Gardeners Hayes may offer a revisit, adjustment, partial refund, or another reasonable resolution.

Any change to the agreed service, including extra tasks, altered timing, or revised waste removal, should be agreed before the additional work is carried out where practical. Verbal changes may be confirmed in writing after the event, but written confirmation is preferred. If the customer requests a major change, the original quotation may no longer be valid.

Either party may end the agreement if the other party materially breaches these terms and fails to remedy the breach within a reasonable period where remedy is possible. Gardeners Hayes may also terminate or suspend services immediately if payment is overdue, the site is unsafe, or continued attendance would create a legal or operational risk.

9. Governing Law

Governing law and final terms for garden servicesThese Terms and Conditions are governed by the laws of England and Wales. Any dispute, claim, or matter arising out of or in connection with the services shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection rules provide otherwise. If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force.

Gardeners Hayes may update these terms from time to time to reflect legal, operational, or service changes. The version in force at the time of booking will generally apply to that booking unless a different version is expressly agreed. By continuing to use the service after updated terms are issued, the customer may be deemed to have accepted the revised wording for future bookings.

In summary, these terms are designed to keep the booking process clear, protect both sides, and ensure that gardening work is delivered safely and lawfully. They establish how Hayes garden services are scheduled, paid for, changed, and completed, while also setting out waste-handling rules and legal responsibilities. Customers are encouraged to review them before confirming any work.
