Gardeners Hayes Service Terms and Conditions
These Terms and Conditions set out the basis on which Gardeners Hayes provides gardening and related outdoor services to residential and commercial customers in our service area. By booking or receiving any service from Gardeners Hayes, you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking.
Definitions
In these Terms and Conditions, the following expressions have the meanings given to them below:
Customer means the individual, company, or organisation requesting or receiving services from Gardeners Hayes.
Services means gardening, garden maintenance, garden clearance, landscaping preparation, lawn care, hedge trimming, pruning, planting, and any related work agreed between Gardeners Hayes and the Customer.
Booking means a confirmed request for Services made by the Customer and accepted by Gardeners Hayes.
Contract means the agreement between the Customer and Gardeners Hayes for the supply of Services, incorporating these Terms and Conditions.
Waste means green waste, soil, turf, clippings, branches, and any other garden-related materials arising from the Services.
Scope of Services
Gardeners Hayes provides professional gardening and outdoor maintenance services, which may include, but are not limited to, lawn cutting, lawn care, pruning, planting, weeding, hedge and shrub maintenance, garden clearance, and general tidy-up. Any specific tasks, service levels, or ongoing maintenance plans will be agreed with the Customer at the time of Booking.
Gardeners Hayes reserves the right to decline work that is unsafe, unlawful, or beyond our reasonable professional capabilities or resources. We may recommend alternative solutions or phased work if necessary to complete the job safely and properly.
Booking Process
All Services must be booked in advance. A Booking is made when the Customer requests Services and Gardeners Hayes confirms availability, price, and any relevant conditions. Confirmation may be provided verbally or in writing.
For larger or more complex jobs, Gardeners Hayes may provide an estimate or quotation based on information and access provided by the Customer. In some cases a site visit may be required before a final quotation can be issued. The Customer is responsible for providing accurate information about the garden size, condition, access, parking, and any particular requirements.
A Contract is formed when the Customer accepts an estimate or quotation provided by Gardeners Hayes, or when the Customer confirms that they wish to proceed after being informed of our rates and availability. By proceeding with the Booking, the Customer confirms that they have read and accepted these Terms and Conditions.
Gardeners Hayes may request a deposit for certain jobs, especially for larger projects, one-off clearances, or where materials need to be purchased in advance. Any such deposit requirements will be made clear before the Booking is confirmed.
Pricing and Estimates
Prices are based on the type of work required, the size and condition of the garden, the number of gardeners needed, and the estimated time and materials required. Gardeners Hayes may charge either a fixed price for specified jobs or an hourly rate for ongoing or open-ended work, as agreed at the time of Booking.
Any estimate is provided in good faith based on the information available at the time. If, upon arrival, the conditions are substantially different from those described (for example, significantly more overgrown areas, restricted access, or additional tasks requested), Gardeners Hayes reserves the right to adjust the price or to decline to proceed with some or all of the work. Any change in price will be discussed with the Customer before continuing.
Unless expressly stated otherwise, all prices are in pounds sterling and are exclusive of any applicable taxes or statutory charges that may be introduced by law. If such charges apply, they will be clearly communicated to the Customer.
Access, Parking, and Customer Responsibilities
The Customer must ensure that Gardeners Hayes has safe and reasonable access to the garden or outdoor area where the Services are to be carried out, including any gates, side entrances, or communal areas. If access is through the Customer's property, the Customer is responsible for ensuring that the route is clear and safe.
The Customer must provide or arrange suitable parking where possible. Any parking charges or restrictions that apply at the property or nearby should be communicated in advance. If parking cannot be reasonably arranged and this affects Gardeners Hayes' ability to carry out the work, we may need to reschedule or charge for additional time.
The Customer is responsible for advising Gardeners Hayes of any known risks, hazards, or specific issues relating to the garden or property, such as unstable ground, hidden features, ponds, underground cables or pipes, or the presence of pets or livestock. The Customer must ensure that pets and children are kept away from active work areas for safety reasons.
Performance of the Services
Gardeners Hayes will exercise reasonable care and skill in performing the Services and will endeavour to carry out the work on the agreed date and within the estimated timescale. Dates and times are, however, subject to weather conditions, access, and other factors beyond our control.
Adverse weather conditions, such as heavy rain, strong winds, extreme heat, ice, or snow, may make it unsafe or impractical to perform certain gardening tasks. In such cases, Gardeners Hayes may reschedule the Booking or adapt the work plan to what is reasonably achievable under the circumstances.
Gardeners Hayes will bring necessary tools and equipment to carry out the work unless otherwise agreed. Where the Customer provides tools or equipment, they do so at their own risk, and the Customer is responsible for ensuring such tools are safe and suitable for use.
Payments and Invoicing
The Customer agrees to pay for the Services in accordance with the rates and terms agreed at the time of Booking. Payment terms will be confirmed when the Booking is made and may differ for one-off and regular maintenance customers.
For one-off jobs, payment is generally due upon completion of the work on the same day, unless otherwise agreed in advance. For ongoing or scheduled maintenance services, Gardeners Hayes may invoice the Customer on a periodic basis. The due date for payment will be clearly stated on the invoice.
Gardeners Hayes accepts commonly used payment methods, which will be confirmed with the Customer when arranging the Booking or issuing an invoice. Cash payments, if accepted, should be made directly to a Gardeners Hayes representative and a receipt can be provided on request.
If payment is not received by the due date, Gardeners Hayes reserves the right to charge interest on overdue amounts at a reasonable daily rate until payment is received in full, and to suspend or cancel any future services for the Customer.
Cancellations and Rescheduling
The Customer may cancel or request to reschedule a Booking by providing reasonable notice. Unless otherwise agreed, we ask for at least 24 hours notice for cancellations or changes to booked appointments for standard jobs, and at least 48 hours notice for full-day or larger projects.
If the Customer cancels or significantly changes a Booking with insufficient notice, Gardeners Hayes reserves the right to charge a cancellation fee, which may be up to a reasonable proportion of the estimated cost of the work or a minimum call-out fee, to cover allocated time and resources.
Gardeners Hayes may need to cancel or reschedule a Booking due to severe weather, staff illness, equipment failure, or other circumstances beyond our control. In such cases, we will notify the Customer as soon as reasonably possible and offer an alternative date. Gardeners Hayes will not be liable for any indirect loss, such as loss of enjoyment or inconvenience, arising from such changes.
Garden Waste and Environmental Regulations
Gardeners Hayes will manage Waste in accordance with applicable environmental and waste disposal regulations in the United Kingdom. Our standard service may include cutting and stacking green Waste neatly on site for the Customer to dispose of, or, where agreed, removal of Waste from the property.
Whether Waste removal is included in the price or charged separately will be confirmed when the Booking is made. If Waste removal is required and not included in the initial estimate, Gardeners Hayes will provide an additional cost based on the volume and type of Waste.
The Customer must not ask Gardeners Hayes to dispose of Waste in a way that contravenes local regulations or national legislation. This includes fly-tipping, burning prohibited materials, or using unsuitable containers. Gardeners Hayes reserves the right to refuse to remove or handle any materials that are hazardous, contaminated, or not reasonably associated with normal gardening activities.
If the Customer prefers to handle Waste themselves, they are responsible for arranging lawful disposal via suitable green waste collections or authorised disposal sites. Gardeners Hayes accepts no responsibility for Waste once it has been left on site in the location agreed with the Customer.
Customer Satisfaction and Complaints
Gardeners Hayes aims to deliver a professional gardening service and wants Customers to be satisfied with the work done. The Customer should inspect the work, where reasonably possible, upon completion or shortly thereafter. If the Customer has any concerns about the Services, they should raise them with Gardeners Hayes as soon as possible so that we can seek to resolve the issue.
Any complaints should be made within a reasonable time after the Services have been carried out. Gardeners Hayes may, at its discretion, return to the property to review the work and, where appropriate, take reasonable steps to address any justified concerns, taking into account the nature of gardening work, plant responses, and seasonal variations.
Liability and Limitations
Gardeners Hayes will exercise reasonable care and skill in providing the Services. However, gardening by its nature involves working with living plants and natural conditions that are outside our control. Gardeners Hayes cannot guarantee specific outcomes regarding plant growth, flowering, or long-term condition, as these depend on weather, soil, pests, diseases, and the Customer's ongoing care.
Gardeners Hayes is not liable for damage arising from existing defects or weaknesses in the Customer's property, including unstable walls, fences, sheds, paving, or garden structures that may be affected by normal gardening activities. The Customer is responsible for informing us of any particular vulnerabilities or restrictions relating to the property.
Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot legally be limited or excluded under applicable UK law.
Subject to the above, Gardeners Hayes will not be liable for any indirect or consequential loss, including loss of enjoyment, loss of use, or loss of profits, arising out of or in connection with the Services or these Terms and Conditions. Our total liability to the Customer in respect of any claim shall not exceed the total amount paid by the Customer for the specific Services giving rise to the claim.
Insurance
Gardeners Hayes maintains appropriate insurance cover for the type of gardening and outdoor work undertaken. Details of cover can be provided on reasonable request. The Customer is responsible for ensuring their own property and contents insurance is suitable for their needs and covers any risks that they are not prepared to bear themselves.
Health and Safety
Gardeners Hayes takes health and safety seriously and will carry out work in a way that is, so far as reasonably practicable, safe for our staff, the Customer, and any third parties. The Customer must co-operate with any reasonable requests made by Gardeners Hayes to reduce risks, such as keeping access clear, securing pets, or avoiding certain areas while work is in progress.
Gardeners Hayes may stop work temporarily or permanently if conditions on site are unsafe, including but not limited to aggressive behaviour, unsafe structures, or prohibited substances present in the work area.
Intellectual Property and Use of Images
Any designs, planting plans, or written materials provided by Gardeners Hayes remain our intellectual property unless otherwise agreed in writing. The Customer may use such materials only for their own property and may not copy or share them for commercial purposes without permission.
With the Customer's permission, Gardeners Hayes may take photographs of the garden before, during, or after the Services for record-keeping and promotional purposes. The Customer may withdraw consent for the use of such images at any time, and Gardeners Hayes will cease using the images in new materials from that point forward.
Data Protection and Privacy
Gardeners Hayes will collect and use personal information about Customers only as necessary to provide the Services, arrange Bookings, and manage accounts. This may include names, addresses, and factual details about the property required to plan and deliver gardening work.
Customer information will be treated with care and will not be sold to third parties. It may be shared only with parties directly involved in providing the Services, or as required by law or regulatory authorities.
Changes to these Terms and Conditions
Gardeners Hayes may update or amend these Terms and Conditions from time to time to reflect changes in law, good practice, or the way we operate our services. The version in force at the time of the Booking will apply to that Booking. A current copy of these Terms and Conditions will be made available on request.
Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or with the Services, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Gardeners Hayes.
Severability
If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or other competent authority, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms and Conditions, together with any written quotation or confirmation of Booking issued by Gardeners Hayes, constitute the entire agreement between the Customer and Gardeners Hayes in relation to the Services provided and supersede any prior understandings, representations, or agreements, whether oral or written.
